Terms and Conditions

These Terms and Conditions (the “Terms”) constitute a legally binding agreement between you and Rakko Inc. (“we,” “us,” or “our”) concerning your download, installation, and use of the Mitasu mobile application (the “App” or “Service”).

By downloading, installing, or using the App, you agree that these Terms will automatically apply to you and that you agree to be bound by them. If you do not agree to these Terms, you must not download, install, or use the App, and you must immediately delete it from your device.

1. Intellectual Property Rights

All intellectual property rights in and to the App, including but not limited to source code, databases, software, designs, trademarks, logos, copyrights, and other related materials, are and shall remain the exclusive property of Rakko Inc. You are strictly prohibited from:

  • Copying, modifying, or creating derivative works of any part of the App or our trademarks in any way.
  • Attempting to extract, reverse engineer, or decompile the source code of the App.
  • Translating the App into other languages or attempting to create unauthorized modifications or localized versions.

2. Medical and Health Disclaimer

PLEASE READ THIS SECTION CAREFULLY BEFORE USING THE APP. BY USING THE APP, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

  • Not a Medical Device: Mitasu is not a medical device. It is not intended, designed, or licensed to diagnose, treat, prevent, or cure any medical condition, disease, dehydration, water intoxication, or health abnormality.
  • General Informational Purpose Only: Any data, calculations, daily hydration targets, notifications, alerts, or insights provided by the App are for general informational, educational, and fitness tracking purposes only. They do not constitute medical advice, medical diagnostics, or a substitute for professional medical consultation, treatment, or judgment.
  • Fluid Restrictions and Health Conditions: If you suffer from kidney disease, renal insufficiency, congestive heart failure, cardiovascular conditions, hyponatremia, or any other medical condition where a physician or healthcare provider has advised you to restrict, monitor, or limit your fluid intake, you must consult with your primary healthcare provider before using the App. Never follow the App’s recommendations or automated hydration goals in place of professional medical instructions.
  • Medical Emergencies: Mitasu must not be relied upon in the event of a medical emergency. If you experience symptoms of severe dehydration, water intoxication, heatstroke, or any acute health issues, you must immediately seek professional emergency medical services (such as calling 911 or 119, or visiting the nearest emergency room). Do not delay seeking medical assistance due to information or recommendations calculated by the App.
  • Assumption of Risk and Liability Disclaimer: Your reliance on the information, hydration targets, and data provided by the App is solely at your own risk. To the maximum extent permitted by applicable law, Rakko Inc. accepts no liability or responsibility for any health complications, adverse physical reactions, personal injury, illness, or damages (direct or indirect) arising from your hydration tracking, water consumption habits, or your reliance on the App’s notifications and features.

3. Subscription and App-In Purchase

Mitasu offers premium features and services via in-app subscriptions (“Subscription”).

  • Billing and Payment: Subscription fees are billed in advance on a recurring, periodic basis (such as monthly or annually). All purchases, transactions, and payments are processed securely by Apple via the App Store. Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Automatic Renewal: Subscriptions automatically renew under the same terms and rate unless auto-renew is turned off or the subscription is canceled at least 24 hours before the end of the current billing cycle.
  • Cancellation: You can manage and cancel your automatic subscription renewal at any time through your Apple ID Account Settings on your iOS device. Cancellation will take effect at the end of the current billing period, and you will retain access to the premium features until that time.
  • Refunds: All transactions are final and handled solely by Apple. Rakko Inc. does not have the authority to process or grant refunds. Any refund requests must be submitted directly to Apple in accordance with Apple’s App Store refund policies.

4. Data Privacy & Local Operation

Mitasu operates with a strong commitment to user privacy.

  • Local Processing: To ensure the security of your records, all hydration entries, logs, and configurations are processed and stored locally on your device or within your private Apple Health (HealthKit) database. We do not store or transmit your personal health or hydration records to our servers.
  • Device Security: It is your responsibility to keep your device and access to the App secure. We strongly recommend against jailbreaking or rooting your device (the process of removing official iOS security restrictions). Doing so may make your device vulnerable to malware, compromise its built-in security features, and cause the App to malfunction or cease operating entirely.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Rakko Inc. be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, data, goodwill, use, or other intangible losses, or any health-related injuries arising out of or in connection with:

  • Your use or inability to use the Service.
  • Any technical malfunction, temporary suspension, or termination of the App.
  • Data corruption or loss resulting from system updates or device failures.

6. Modifications to the Service and Updates

We reserve the right to modify, update, suspend, or terminate the App or any part of the Service at any time, for any reason, with or without prior notice.

  • Required Updates: We may release updates to the App from time to time to enhance security, functionality, or compatibility. You agree to download and install updates to ensure the continuous and proper operation of the App. We do not guarantee that the App will always support your specific device or iOS version.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, invalidity, breach, or termination thereof, shall be subject to the exclusive jurisdiction of the Tokyo District Court of Japan in the first instance.

8. Changes to These Terms

We may revise and update these Terms from time to time. You are advised to review this page periodically to stay informed of any changes. Any modifications to these Terms will become effective immediately upon being posted on this page.
